TERMS AND CONDITIONS OF SALE

1. Site owner
The digital platform is owned by CONTE TASCA D'ALMERITA SOC. AGR. ARL, with registered office in Via dei Fiori, 13 – 90129 Palermo (ITALY), VAT number 06056430827.

2. Regulation and Acceptance of the General Conditions of Sale
These general conditions of contract (hereinafter also "General Conditions") govern the offer by Conte Tasca d'Almerita Soc. Agr. Arl (henceforth also “CTdA”). The General Conditions must be accepted by the User when registering on the Site, in order to be able to use the service offered.

CTdA reserves the right to modify all or part of these conditions at any time, giving notice to the User by publishing them on the Site.

In this case, the User who continues to use the platform after the publication of the changes will also accept the new conditions.

3. Registration on the site
The services offered on the Site are aimed exclusively at Users who have reached the age of 18.

Registration on the site is free. The User can register by providing, in a truthful and complete manner, all the data requested in the relative registration form and fully accept the privacy policy and these general conditions. The User undertakes not to transfer his credentials, even temporarily, to third parties and to keep them with due care, diligence, and secrecy under his own responsibility, constituting the only means to identify the User and to validate his access to the offers. The User is therefore informed that all the acts performed through the use of these credentials will be attributed to him and will have binding effect on him. It is understood that under no circumstances can CTdA be held responsible in the event of loss, dissemination, theft or unauthorized use by third parties, for any reason whatsoever, of the Users' access credentials.

In any case, it will be possible to proceed with the purchase with a "quick check out" by entering the email address and the data relating to the shipment.

Partial registration on the Site is also permitted (hereinafter also "Partial Registration"), by entering only the user's e-mail address for receiving the newsletter.

In the event that the User who has made a Partial Registration then wishes to proceed with the purchase of the Products on the Site, it will be necessary, before the checkout phase, to complete the insertion of the mandatory fields, necessary for the completion of the purchase.

At any time, the User may update and/or modify or request the deletion of the information provided during Registration. In the event of a cancellation request, however, CTdA may temporarily maintain, in whole or in part, such information, for the sole purpose of executing any purchases made and/or being able to conclude the accounting and tax procedures.

CTDA reserves the right to suspend or cancel the User's account at any time and without notice if it deems that:

– the User has violated the Agreement

– access to or use of the Service could cause damage to CTdA, to other Users or to third parties;

– the use of CTdA by the User may result in a violation of the applicable law or regulation;

– in the event of investigations conducted as a result of legal actions or due to the involvement of public authorities;

– the account is deemed by CTdA, at its sole discretion and for any reason whatsoever, to be inappropriate or offensive or in violation of the Contract or not in line with CTdA's standards.

4. Locating products
The range of products relates to the categories of food, alcohol (wine products), extra virgin olive oil. The Products offered for sale on the Site are only those advertised therein in the dedicated section.

The images of the products are purely illustrative and do not constitute a contractual element.

The product catalog may provide for product availability subject to quantitative and/or time limits.

5. Conditions of the offer
Before concluding the purchase, the User must read the characteristics of the goods illustrated in the data sheet of the product he intends to purchase, respecting the purchase limits where indicated; Prices (expressed in euros and inclusive of VAT), descriptions or product availability may be subject to change without notice, effective from the date of publication of said changes on the Site. CTdA will do its best to present the characteristics of the products with the greatest degree of detail possible within each sheet corresponding to the product viewed by the User. However, the images and colors of the products offered for sale may differ from the real ones due to multiple factors including, but not limited to, the User's terminal monitor, photographic filters, etc. Therefore, the User acknowledges and accepts that any such minor differences do not constitute a lack of conformity of the products.

Shipping costs for Italy have a fixed amount of €9.00 and will be free if the total amount in the cart exceeds €110.00; Furthermore, it is possible to request an express shipment with delivery within 24 hours following the order, only on weekdays, at a cost of € 35.00 and for a maximum of 24 bottles. In any case, the user is always informed of the amount of the shipping costs before concluding the purchase procedure and making the payment.

In some cases it is possible that the availability of an asset ends after the purchase: in these cases, if the conditions are met, CTdA will refund the User.

The products on the Site are intended to be sold for personal use. Consequently, the User ensures that he acts as a final consumer and that he does not intend to resell, directly or indirectly, the products purchased on the Site and/or by telephone for commercial purposes.

6. Purchase procedure and payment methods
Each order sent constitutes an offer to purchase the products covered by the order.

Order fulfillment is subject to the availability of the products ordered and to the discretionary acceptance of the same by Conte Tasca d'Almerita. In any case, the company reserves the right to cancel the orders by re-crediting the sums paid.

The User must select the products and complete the check-out, after carefully checking the information contained in the order summary. The order is placed through confirmation of the same and is subject to payment of the price, taxes and shipping and payment costs indicated.

Following the successful completion of the payment, the User will receive an order confirmation email containing the information relating to the offer purchased. The order confirmation will contain a summary of the delivery and billing address. In the absence of the confirmation e-mail, the purchase cannot be considered validly concluded.

The accepted payment methods are: Amex-Visa- PayPal- Apple Pay- Google Pay- Maestro-Mastercard- Shop Pay

Unless otherwise specified in the terms of the offer, the sums due are charged at the time of payment confirmation. In any case CTdA uses third party tools for payment processing and does not in any way come into contact with the payment data, such as those relating to the credit card, provided.

In the event of non-confirmation of the order for any reason, CTdA will refund the full amount paid by the user.

7. Shipping, delivery and after-sales service
CTdA only accepts orders with delivery on the Italian territory.

CTdA undertakes to deliver the goods within 10 working days from the date of the order. The shipping service is operated by UPS. The user can therefore check the shipping status of the order using the platform made available by UPS.

CTdA cannot be held responsible for errors in delivery due to inaccuracies or incompleteness in completing the purchase order by the User, for damage that may have occurred to the Products after delivery to the carrier, for delays in delivery attributable to the latter .

CTdA uses patented packaging approved by the courier, designed to guarantee the integrity of the product. In any case, upon delivery of the goods, the User will be required to verify that the packaging is intact, undamaged, or otherwise altered, including in the sealing materials (adhesive tape or strapping) or that there is no leakage of liquid. Any damage to the packaging and/or the product must be immediately contested by the User, placing a written control reserve (and specifying the reason for the reserve, e.g. "Hounded packaging", "Crushed packaging", etc.) on the courier delivery. Once this document has been signed, the User will no longer be able to make any objection regarding the characteristics of what has been delivered. Any problems relating to the physical integrity, correspondence or completeness of the products received must be reported within 3 days of delivery, by contacting the dedicated Customer Service, by sending an email to customercare@tascadalmerita.it ; in the communication, the User must provide a description of the defect found, indicate the product code as well as the progressive order number issued at the time of purchase and the identification details of the invoice issued by the seller in relation to the products purchased.

In the event of non-delivery of the goods within the times indicated, the User will be required to notify CTdA via customercare@tascadalmerita.it who will check the status of the shipment and any anomaly with the courier. Following a shipping anomaly (for example parcel lost or destroyed during transport), CTdA will proceed to send the product again, compatibly with the availability of the same in the warehouse or to fully refund the order.

8. Product warranty and conformity
The User is also aware that the images used on the proposals can sometimes only be indicative of the product and do not always faithfully represent the delivered product. CTdA will be directly responsible for the conformity of the products. In case of non-compliant products, the User will contact the dedicated Customer Service by sending an email to customercare@tascadalmerita.it .

CTdA will collect the bottle(s) in order to start the verification procedure. For the verification it will be necessary that in the bottle/s there is at least 70% of the wine and that the original cork is well inserted on the neck. Subsequently, if the anomaly is ascertained, we will proceed with the replacement or refund.

9. Withdrawal
In case of purchase of products, the purchaser has the right to withdraw from the contract within the term of 14 (fourteen) days starting from the date of receipt of the products, returning the delivered goods intact and without any alteration to CTdA. The right of withdrawal does not apply to products delivered sealed that have been opened by the Customer. The notice of withdrawal must be sent by e-mail to customercare@tascadalmerita.it within 14 days from the date of delivery and must contain:

  1. the demonstration by the user to exercise the right of withdrawal pursuant to and for the purposes of art. 54 of Legislative Decree no. 21/2014;
  2. the indication of the products for which the customer intends to exercise the right of withdrawal, including the specification of the article code of the product;
  3. the progressive order number issued at the time of purchase;
  4. the identification details of the invoice issued by the seller in relation to the products purchased.

The buyer who has exercised the right of withdrawal must return the goods intact and without any alteration within 14 days from the date of receipt of the products. The costs of returning the goods are borne by the user. The goods must be sent to Conte Tasca d'Almerita, Via dei Fiori 13-90129 Palermo.

The user is responsible for the packaging of the goods he intends to return, therefore he undertakes to take the necessary precautions in order to safeguard the integrity of the product or products to preserve them from any damage and/or any alteration.

The goods must be returned intact, in their original packaging, complete in all their parts, accompanied by the attached tax documentation. Without prejudice to the right to verify the above, CTdA will proceed by crediting the withdrawn contractor with the amount paid for the purchase of the product/products within the maximum term of thirty days starting from the date on which the seller became aware of the exercise of the right of withdrawal occurred.

In any case, the amount paid will not be credited before:

  1. CTdA has received the shipment of the product(s);
  2. CTdA has verified the integrity of the product(s).

The clauses concerning the exercise of the right of withdrawal, as well as the relative consequences and exceptions, apply exclusively to the User who qualifies as a consumer, i.e. to the User who acts for purposes unrelated to his business and professional activity.

10. Liability of Conte Tasca d'Almerita Soc. Agr. Arl
CTdA will not be responsible for damages that may arise from the use of the Site such as computer viruses, omissions, service interruptions and software failures, even to the detriment of the User's computer equipment, which prevent or delay the provision of services if these are due to external causes, force majeure and/or third parties not dependent on the will of the owner.

In any case, CTdA cannot in any case be held responsible for delays or defects or discrepancies due to events beyond their reasonable control such as, by way of example:

(i) force majeure events;

(ii) events dependent on third parties such as the interruption or malfunction of the services of telecommunications operators and/or power lines, or acts or omissions by carriers or shippers.

11. Industrial and intellectual property
Conte Tasca d'Almerita is the owner of all rights relating to the graphic and conceptual content of the Site, of the distinctive signs made visible therein, as well as any name, symbol, image used to indicate the Products on the site. Reproduction, even partial, of the content and graphics of the Site, as well as of the distinctive signs made visible therein, is therefore prohibited.

12. Privacy
Personal data is collected and processed in order to follow up on User requests. CONTE TASCA D'ALMERITA guarantees its users to operate in compliance with the legislation on the processing of personal data, governed by the Privacy Code pursuant to GDPR 2016/679. The privacy policy is to be considered an integral and substantial part of these General Conditions and can be accessed in the Privacy section of the Site or from the link to the Privacy Policy. 13. Governing Law and Jurisdiction
These General Conditions will be governed in every aspect by Italian law. For any dispute concerning the interpretation, execution and/or termination of the contract between the User and CONTE TASCA D'ALMERITA, the Parties acknowledge that the Judge of the place of residence or domicile of the User will be competent, if the same is to be considered a "consumer" on the basis of the applicable laws in force.

In any case, to resolve any disputes deriving from online purchases of goods and services out of court, the consumer can connect to the ODR telematic platform, which can be reached at the address https://webgate.ec.europa.eu/odr 


GENERAL TERMS AND CONDITIONS FOR VISITS IN THE WINERY

General conditions
The tastings are dedicated only to adults, as it is not allowed to serve alcohol to children under 18 years of age. The presence of minors is expected only if accompanied by adults.

All prices are inclusive of VAT; for minors, participation is free;

Please report any food allergies and intolerances or any other specific need within two working days of the visit with tasting by writing to hospitality@tascadalmerita.it . Unless previously reported, Conte Tasca d'Almerita will decline any responsibility and nothing can be claimed as a refund.

General conditions of modification or cancellation of the reservation
The booking is to be considered confirmed only after the booking order confirmation email from Conte Tasca d'Almerita .

Any changes must be communicated in writing to hospitality@tascadalmerita.it , within 2 working days from the date of the visit, providing name, surname and booking code:

  • in the event of a decrease in the number of booked guests and a change in the type of tasting, if communicated within the aforementioned term, the corresponding amount will be credited back directly to the credit card used; in case of late communication the amount due will be withheld;
  • in the event of an increase in the number of booked guests and a change in the type of tasting, the booking must again be confirmed by email from Conte Tasca d'Almerita.

The cancellation of the reservation must necessarily be communicated in writing to the email address hospitality@tascadalmerita.it .

The cancellation of the reservation must be received no later than 2 working days from the date of the visit, providing name, surname and booking code. If communicated within the aforementioned term, the corresponding amount will be credited back directly to the credit card; in case of late communication, the entire amount due will be withheld.

Conte Tasca d'Almerita reserves the right to change the place of the event or to cancel the event, at any time, due to force majeure and/or impossibility (including the cases, by way of example but not limited to, of meteorological events that make it impossible to organize the event, impediments caused by the Covid-19 emergency, etc.). Participants are guaranteed a full refund of the ticket, using the same means of payment used for the purchase, whether the event is canceled or the change in location does not allow the buyer to take part in the visit with tasting.

General rules of conduct for visitors
It is recommended to pay maximum punctuality on the established visit time. Furthermore, in order to guarantee the adequate and regular development of the wine tourism experience, a maximum delay of 20 minutes from the agreed time may be tolerated.

The time of the visit is pre-established and cannot be modified, in compliance with the reservation of the rest of the participating group.

Entry to the premises is permitted only if accompanied by authorized personnel.

Conte Tasca d'Almerita declines all responsibility for damages to things and people deriving from the negligent conduct of visitors.

General Anti-contagion Safety Rules Covid-19
Conte Tasca d'Almerita ensures and guarantees compliance with the anti-Covid-19 legislation, in compliance with the indications provided by the Ministry of Health at the time of the visit and tasting.

WINE CLUB GENERAL TERMS AND CONDITIONS

By joining the Wine Club, members will be able to choose between two profiles, Mathusalem and Balthazar, and will have access to wines selected for them by Tasca which they will receive in customizable wooden boxes, they will be able to buy old vintages and enjoy exclusive experiences in the Tasca world.

The wines selected by Tasca for Wine Club members can only be shipped to Italy.

Based on the availability of wines, Conte Tasca d'Almerita reserves the right to replace one or more bottles of the chosen selection.

A dedicated Customer Service is also provided for Members. It will be possible for any need or request to write to wineclub@tascadalmerita.it .

The services chosen by Members will be active for 12 months from the date of membership. Within this period, if required by the profile, it will be necessary to communicate the choice of the Estate and the type of tasting, as well as the date to participate in the masterclasses, by writing to wineclub@tascadalmerita.it
